Terms of Service

These terms are an agreement between you and the developer of Steaper (“we”, “us”) covering the Steaper iPhone app and this website. By downloading or using Steaper you accept them. If you don’t, don’t use the app.

This agreement is between you and us only — not with Apple. Apple is not responsible for Steaper or its contents.

We grant you a personal, non-transferable, non-exclusive licence to use Steaper on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not rent, lease, lend, sell, redistribute, sublicense, reverse-engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law.

The app, its design, its text, and the brewing database remain ours. Your licence does not transfer ownership of any of it.

Steaper is a brewing timer and a reference book. Its temperatures, ratios, rinse rules and steep times are drawn from independent gong fu sources and offered as a starting point — they are not a standard, a certification, or a guarantee of a good cup. Leaf age, vessel, water and taste all move them, and you should trust your own palate over our numbers.

Nothing in the app is health, dietary or medical advice. Tea contains caffeine. If you have a condition affected by caffeine, or you are pregnant, talk to a doctor rather than to a timer.

Brewing tea involves very hot water. Handling kettles, gaiwans and teapots safely is your responsibility. We don’t supervise your kitchen and we aren’t liable for scalds, spills, or broken porcelain.

We are solely responsible for providing any maintenance and support for Steaper. Apple has no obligation to furnish any maintenance or support services. You can reach us at hello@steaper.com; there is no guaranteed response time, but a person does read it.

Steaper is provided “as is” and “as available”, without warranty of any kind to the fullest extent permitted by law. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Steaper. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.

Nothing here limits any statutory rights you have as a consumer that cannot be limited by agreement.

We, not Apple, are responsible for addressing any claims by you or a third party relating to Steaper or your use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

If a third party claims that Steaper or your use of it infringes their intellectual property, we — not Apple — are responsible for the investigation, defence, settlement and discharge of that claim.

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from your use of the app, including any loss caused by a steep that ran long because a timer, a notification or a device behaved unexpectedly.

By using Steaper you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Steaper collects nothing. There is no account, no analytics, and no network code in the app at all. The privacy policy explains that in full, and separately describes what this website logs.

We may update these terms as the app changes. The date at the top will change with them, and continued use after an update means you accept the revised terms. We won’t apply a material change retroactively.

These terms are governed by the laws of the Czech Republic, except where mandatory consumer-protection law in your country of residence gives you stronger rights — in which case those rights apply.
